Nişancızâde'nin Nûru'l-'Ayn Adlı Eserinin Tahkik ve Tahlili (33. Fasıl)

Abstract

On yedinci yüzyıl Osmanlı fakîhi olan Nişancızâde, Şeyh Bedreddin'in yargılama hukukuna dair olan ve uzun yıllar hakimlerin el kitabı olarak kullanılan eseri Câmi'u'l Fusûleyn'i düzenlemek ve ıslah etmek amacıyla Nûru'l-'Ayn fi Islâhi Câmi'u'l Fusûleyn adlı eseri kaleme almıştır. Bu çalışma, Nûru'l-'Ayn'ın "Ahkâmât" faslı (33. fasıl) ile Câmi'u'l Fusûleyn'in "Ahkâmât" faslının (34. fasıl) incelenmesini ve karşılaştırılmasını hedeflemektedir. Nûru'l-'Ayn'da "Ahkâmât" faslı kırk bir adet başlıktan oluşmaktadır. Bu başlıkların bir kısmı Câmi'u'l Fusûleyn'le ortakken, bir kısmı Nişancızâde'nin fasla ilave ettiği başlıklardır. Araştırmamız üç bölümden oluşmaktadır. İlk bölümde, iki eser arasındaki ortak başlıklar üslup ve telif tarzı bakımından karşılaştırılmış, Nişancızâde'nin nerelerde ve hangi yöntemlerle ıslahta bulunduğu incelenmiştir. İkinci bölümde, Nişancızâde'nin bölüme ilave ettiği başlıklar üslup ve telif tarzı bakımından ele alınmış, bu başlıkların nereden alıntılandığı ve kapsamında bulunan konuların klasik fıkıh kitaplarındaki yeriyle ilgili genel bir çıkarım yapılmıştır. Üçüncü bölümde ise Nûru'l-'Ayn'ın 33. faslı, aralarında bazı farklar bulunan iki farklı müellif nüshasına dayanılarak tahkik edilmiştir.

Nişancızâde who was an Ottoman faqîh of the seventeenth century wrote a book in order to reform and improve the book of Şeyh Bedreddin which is related to administrative jurisdiction and had been used as a workbook of kadis (Muslim judges) for many years. This study aims at examining and comparing to the chapter of "Ahkâmât" (33rd chapter) in Nûru'l-'Ayn and the chapter of "Ahkâmât" (34th chapter) in Câmi'u'l Fusûleyn. The chapter of "Ahkâmât" in Nûru'l-'Ayn is composed of forty-one titles. While some of those titles are in common with Câmi'u'l Fusûleyn, some of the titles are the ones which were added to the chapter by Nişancızâde. This study consists of three chapters. In the first chapter, the titles which were in common with two books have been compared in terms of wording and writing style and were examined in terms of Nişancızâde's methods that were used while reforming the book and which parts in the book he made reforming. In the second chapter, the titles which were added to the chapter by Nişancızâde were addressed in point of wording and writing style and it's been deduced generally that where those titles came from and where the subjects are which included in those titles in classical Islamic law books. In the third chapter, an edition-critique of the 33rd chapter of Nûru'l-'Ayn is produced as found in two author's copies containing some differences.
