Furûk yazımının bey’ akdi özelinde analizi

Abstract

Furûk, hicri IV. yüzyıldan itibaren müstakil eserlerin kaleme alındığı, benzer görünen kavram, kâide ve meseleler arasındaki farkların incelendiği İslam hukukunda bir yazım türüdür. Fıkıh ve usul kitaplarında işlenen konular, furûk yazımında farklı bir gaye ve üslupla tekrar ele alınmış; benzer görünen ancak farklı hüküm alan kavramların, kâidelerin ve meselelerin, mukayese usulüyle farklılaşma gerekçeleri delillendirilmiştir. Giriş ve iki ana bölümden oluşan bu çalışmanın giriş bölümünde, araştırmanın içeriğine kısaca değinilerek Türkiye'de ve yurtdışında fıkhî furûk yazımı üzerine yapılan çalışmalara yer verilmiştir. Birinci bölümünde, bir yazım türü olarak furûk incelenerek bu alanda ortaya çıkan literatürün bir listesi sunulmuştur. İkinci bölümünde ise, furûk eserleri bey' akdi özelinde incelenerek bu yazım türünde neler yapıldığı ve bu yazım türünün hangi gayeyle kaleme alındığı tespit edilmeye çalışılmıştır. ----- Furûq is a type of writing in Islamic law, in which independent works were written since the fourth century AH and concepts, rules and issues which had legal distinctions between seemingly similar cases were examined. These subjects, which were covered in fiqh and usul books, were re-examined with a different purpose and style in the writing of furûq; the reasons for differentiation of concepts, rules and issues, which seem similar but have different provisions, have been substantiated by comparison method. In the introduction part of this study, which consists of an introduction and two main parts, the content of the research has been briefly mentioned and the studies on the writing of al-furûq al-fiqhiyya in Turkey and abroad has been included. In the first part, furûq as a type of writing has been examined and a list of the literature written in this field has been presented. In the second part, the works of furûq have been examined in terms of the bey' contract, and it has been tried to determine what was done in this type of writing and for what purpose this type of writing was written.
