Tacüddin es-Sübki’nin el-Eşbah ve’n-nezair isimli eseri

Abstract

Fıkıh literatüründe "usûl" (esaslar) dendiğinde bir taraftan İslam hukuk ilminin felsefî ve metodolojik esaslarını inceleyen "usûlü'l-fıkh"ın, diğer taraftan da fıkhî hükümlerin fikrî temellerine ve hedeflediği amaçlara yoğunlaşan ilke ve kurallar anlamındaki "kavâid"in anlaşılması gerekir. Bir kısmı doğrudan naslarda ifadesini bulmuş olan ve fıkıh âlimlerinin İslâm'ın ana kaynaklarının iyi anlaşılması uğrunda ortaya koydukları fikrî çabaların ürünleri olarak belirlenen fıkıh kâidelerinin özel biçimde incelenmesi fıkıh literatüründe önemli bir yazım türü oluşturmuştur. Birçoğu hukuk vecizesi şeklinde ifade edilen kâidelerin fıkıh düşüncesi ve uygulamasındaki yararları ve işlevi hakkında farklı değerlendirmeler yapılmıştır. Kavâidin işlevi, usûl ve fürû alanlarındaki çeşitleri ve kapsadığı cüz'î meseleler hakkında kaleme alınan kitaplar arasında eşbâh türü eserlerin önemli bir yeri vardır. Eşbâh edebiyatında telif edilen ilk ve en önemli eserlerden biri Tâcüddîn es-Sübkî'nin el-Eşbâh ve'n-nezâir'idir. Mezkûr eserin eşbâh edebiyatındaki yerinin, muhteva ve metodunun incelendiği bu çalışma, giriş, iki bölüm ve sonuç kısımlarından oluşmaktadır. ----- When "usûl" (principles) is mentioned in the fiqh literature, "usûlü'l-fiqh", which examines the philosophical and methodological principles of fiqh, on the one hand, and "qawaid" (plural of qaidah), which means "the principles and rules that focus on the intellectual foundations and aims of the rulings of fiqh", on the other hand, must be understood. A special examination of the qawaid of fiqh, some of which were directly expressed in the texts and which were determined as the products of the intellectual efforts of Muslim jurists for the sake of understanding the main sources of Islam, constituted an important type of writing in the fiqh literature. Different evaluations have been made about the benefits and functions of these qawaid, most of which are expressed as legal maxims, in the thought and practice of fiqh. Among the books written about the function of the qawaid, its types in the fields of usûl and furû, and the particular issues it covers, works such as al-Ashbah have an important place. One of the first and most important works written in al-Ashbah literature is al Ashbah wa al Nazair of Taj al-Din al-Subki. This study, which examines the place, content and method of al Ashbah wa al Nazair of Taj al-Din al-Subki in al Ashbah literature, consists of an introduction, two sections and a conclusion.
